Process Serving

Process serving is an important cog in the wheels of justice. Our charge is to ensure documents of all types and of all jurisdictions are served upon individuals or companies. Service requirements are varied depending on what each jurisdiction allows with some documents requiring "personal" service and others that may simply allow for the documents to be left at an address in a letter box.
There is often a misconception that documents must be "accepted" by or placed in the hands of the person being served. Within the Victorian (Aust.) jurisdiction this is not the case. Service is considered to have occurred if, by necessity,the documents are simply placed in the "presence" of the person, providing the nature of the documents is explained to the person at the time of service. This may be achieved by placing the documents on the doorstep, in front of the person, following a conversation and confirmation of identity of the said person. There are many variations of this mode of service, with details of such actions always explained fully to the client by way of a detailed "affidavit of service". Even the words Personal and Non-Personal service are often misused within our own industry, in fact "Non-Personal" is not actually a term recognised in the Rules of Service (Vic Mag Court) rather, so called non-personal service is actually considered "personal service" according to The Act. (For instance, it is considered "personal" service has been achieved if a document is delivered to a persons place of residence and is given to a fellow resident, providing this resident is above the age of 16 years.). Confused? Well that is why you should trust all your process serving needs to the experts!

Fees and Charges for process serving vary widely, depending on the types of documents to be served and the locality of the service address together with any difficulties encountered whilst attempting to effect service. Our fees are generally derived from the fees and charges recommended by the courts (Follow this link to download court scale fees). Discounts are offered to clients offering high volumes of process, this may be in the form of percentage discounts off scale fees or even flat fee for service, depending on clients needs. Some matters may attract additional fees, such as those that require VERY urgent attention, although such fees are rarely applied as we usually attend to all matters within a 24/48 hr time frame. Attempted service fees are kept to a minimum within our charging regime.

Field Calls

A Field Call is a personal visit by one of our licenced agents to the given address of a subject. On such visits our instructions may be simply to establish contact with or confirm residency of a person whom has failed to respond to correspondence right through to obtaining a comprehensive statement of a persons financial affairs.
Field Calls are an often under-utilised tool open to our clients. It can be a very cost effective option whether that be by achieving certain results without proceeding to more expensive legal options or by simply using the results to determine the likelihood of success through legal action. What is often the case, particularly with respect to monies owing is that communication has broken down between creditor and debtor. A Field Call can re-establish this communication to great effect, with our agents and or company acting as an intermediary in the process. Field Calls are certainly not limited to matter relating to debts, although this is the main area in which this service is used. A typical field call will involve the agent making formal demands for, or collection of a payment, establishing overall financial position of the subject including obtaining employment details, updating phone numbers and seeking repayment arrangements.
All of our staff involved in performing Field Calls are licenced Commercial or Sub-Commercial Agents. This licence enables our agents to discuss debts on behalf of our clients, right through to the actual collections of cash or where necessary the repossession of encumbered goods or property.
The price of a Field Call varies depending on a number of factors, including the locality of the address and what is actually required with respect to the visit, together with discounts given to client with high volumes of work. A standard field call will cost in the vicinity of $44 however visits can be performed for as little as $22 and more than $66 for matters requiring extended interviews to be performed. We do not charge for any attempts made in trying to speak to an occupant or subject of a given address and only the one, quoted fee will ever apply, irrespective of the locality of the visit within our service area or the number of attempts necessary to bring the field call to a conclusion. A field call is considered completed if: (1) Contact is made with a subject (2) Contact has been made with the occupants whom indicate the debtor has moved (3) Contact has been made with neighbours and they indicate that the subject has left the address. Obviously basic location inquiries will be made if it is discovered a subject has moved, such as determining rental agents or possible forwarding addresses. All reports will be typed and can be returned by any method to suit your needs. Our systems also allow us to tailor our reports to suit any clients needs or wishes. Repossessions

Repossession is usually only ordered after all communication has broken down or a debtor has found themselves in a situation where their income is not sufficient to meet their repayments. It is never easy and a fine line must be tread to ensure a good result is achieved for all parties concerned.
We are experienced in repossessing all manner of encumbered security including residential and commercial property, cars, motorcycles, trucks, boats, computers, household goods/furniture all the way through to aeroplanes and the like. If it's encumbered and if we are instructed to do so, we will ensure its' return.
Our agents are very experienced and trained to deal with these often sensitive and emotional situations. We are always courteous and considerate of the debtors situation and do everything possible to ensure that repossession is avoided. This is usually done by working with the debtor to assess their likelihood of being able to pay the full arrears plus any additional costs within a reasonable time frame. Should this not be achievable then our agents will follow through with the repossession in a timely and professional manner.

Investigations

Investigation is a very general term to describe many activities that we are asked to undertake. An investigation may involve actual surveillance where a target or subjects' activities are observed and recorded or may simply be where we are asked to locate a person that lost contact with loved ones. Each investigation is unique and often requires unique solutions to achieve the final objective. All our investigations are carefully planned and executed so as to achieve the highest possible result for the client.

Costs vary depending on many factors as as such each investigation has to be priced and or quoted individually.
